Terms & Conditions

These terms and conditions (“User Terms”) apply to your visit to and your use of the website and Services at www.publiccab.com (the“Website”) whether through a computer or a mobile phone, the Service and the Application (as defined below), as well as to all information, recommendations and or services provided to you on or through the Website, the Service and the Application. For the purposes of this User Terms.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.

BY ACCESSING THIS SITE AND ANY PAGES THEREOF , THE CUSTOMER AGREES TO BE BOUND BY THE TERMS AND CONDITIONS BELOW.

DEFINITIONS

In these terms and conditions:

  • "Public Cab" means Public Cab Sdn Bhd.
  • "Customer" means a person who is a customer of Public Cab who uses its Online Taxi Booking Services.
  • "Online Taxi Booking Services" means Public Cab Taxi Business automated taxi booking and dispatch services and other taxi booking services as may be determined by Public Cab Taxi Business from time to time.
  • Words importing the singular number include the plural number and vice versa and words importing the masculine gender include the feminine and neuter gender and references to any gender include any other gender.
  • "Personal Data" shall have the meaning as defined in the Public Cab Taxi Business Privacy Policy

Public Cab shall upon receiving the order request from customer via Public Cab Online Taxi Booking Services , proceed to confirm or decline the booking based on the availability of vehicles at the pick up time, which shall be informed to customer via call by the staff of Public Cab.

Customer must provide Public Cab with a genuine contact number so that our operations staff can get in contact with customer if needed in relation to Public Cab Taxi Services. For all bookings, customer (or a member of customer) must be contactable anytime , and immediately prior to customer designated pickup time on the same contact number that customer have listed during booking. If customer is not contactable on designated phone number, Public Cab will not be liable for any costs, damages or losses that Customer may incur as a result of not meeting scheduled travel time.

The Customer shall pay a prevailing booking fee for either current booking or advance booking in addition to the payment of taxi fare and any fee or levy now or hereafter imposed by the law or required to be paid in respect of any monies payable to or receivable by Public Cab Taxi Business or any expenses incurred by Public Cab Taxi Business here under (except to the extent prohibited by law).
The customer may choose to pay for the transportation services by either of the following two methods:

  1. Cash payment:
    Cash payment after the completion of transportation services can be made to the driver nominated by the Public Cab for the settlement of the fare payable. You are responsible for the timely payment of all fees in cash to the driver nominated by the Public Cab.
  2. Online payment:
    Public Cab offers you the facility of making an online payment through “Credit Card / Debit Card” method powered by a third party payment processor. The processing of payments or credits, as applicable, in connection with your use of the “credit card/debit card” will be subject to the terms, conditions, and privacy policy of the Payment Processor that Public Cab engages for the purpose.
    Public Cab will not responsible for any errors by the Payment Processor in connection with customer’s use of the Services. Public Cab will obtain transaction details, which Public Cab will use solely in accordance with its Privacy Policy. In the event the payment cannot be accepted through any of the methods offered on the website or application, you shall be required to pay the fare of the transportation services in cash.
  1. Customer may cancel the online booking 2 Hour prior to the time of journey, without any cancellation charges for all services.
  2. Cancellation done 2 Hours before travel are subject to cancellation charges. Booking Fee is non-refundable, the balance after deducting the booking fee can be refundable to the customer. Subject to deduction on any charges that cannot be covered with booking fee.
  3. Cancellation done within 2 Hours prior to arrival or no show, will subject to a full cancellation charges.

Customer shall be responsible for the cost of repair for damage to, or necessary cleaning of vehicles and property resulting from use of the Services by customer in excess of normal "wear and tear" damages and necessary cleaning. In the event that a driver reports the need for Repair or Cleaning, and such Repair or Cleaning request is verified by Public Cab's reasonable discretion, Public Cab reserves the right to facilitate payment for the reasonable cost of such Repair or Cleaning on behalf of the drivers and reimburse such cost from customers.

The Customer shall not hold Public Cab Taxi Business liable for any direct or indirect loss or damage which may be suffered by the Customer as a result of any failure by Public Cab Taxi Business to provide a taxi to the Customer.

The Customer shall not hold Public Cab Taxi Business liable for the use of location based information provided by any of the telecommunication companies when the Customer uses the mobile phone to make a taxi booking. The location based information will be used only to facilitate and improve the probability of locating a taxi for the Customer.

In no event will Public Cab be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damage, losses or expenses arising in connection with this site or any linked site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Public Cab, or representatives thereof, are advised of the possibility of such damages, losses or expenses.

The Customer undertakes with Public Cab Taxi Business and agrees to indemnify Public Cab Taxi Business from and against and in respect of any or all liabilities, losses, charges and expenses (including legal fees and costs on a full indemnify basis) claims, demands, actions and proceedings which Public Cab Taxi Business may incur or sustain directly or indirectly from or by any reason of or in relation to the use or purposed use of Online Taxi Booking Services and shall pay such sums on demand except to the extent that such liabilities, claims, damages, losses, costs and expenses are directly and solely caused by the willful misconduct of Public Cab.

By accepting these Terms and using the Service, the customers agrees to defend, indemnify and hold Public Cab, its officers, directors, other users, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys' fees and costs) arising out of or in connection with the customer’s violation or breach of any term of these User Terms or any applicable law or regulation.

Public Cab shall have no liability to customer if Public Cab are prevented from, or delayed in performing any Public Cab Services due to any act, event, omission or accident beyond its control, including industrial disputes, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or sub-contractors.

This site may contain links to websites controlled or offered by third parties (non-affiliates of Public Cab ). Public Cab hereby disclaims liability for, any information, materials, products or services posted or offered at any of the third party sites linked to this Website. By creating a link to a third party website, Public Cab does not endorse or recommend any products or services offered or information contained at that Website, nor is Public Cab liable for any failure of products or services offered or advertised at those sites, such third party may have a privacy policy different from that of Public Cab and the third party website may provide less security than the Public Cab’s website.

The information and materials contained in this site, including text, graphics, links or other items are provided as is as available. Public Cab does not warrant the accuracy, adequacy or completeness of this information and materials and expressly disclaims liability for errors and omissions in this information and materials. No warranty of any kind, implied, expressed or statutory including but not limited to the warranties of non-infringement of third party rights, title, merchant ability, fitness for a particular purpose and freedom from computer virus, is given in conjunction with the information and materials.

The information and materials contained in these pages, and the terms, conditions, and descriptions that appear, are subject to change. Unauthorized use of Public Cab web sites and systems including but not limited to unauthorized entry into Public Cab systems, or misuse of any information posted on a site is strictly prohibited.

This site is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation.

Public Cab shall be entitled to add to, vary or amend any or all these terms and conditions at any time and the Customer shall be bound by such addition, variation or amendment once such addition, variation or amendment are incorporated into these terms and conditions at Public Cab website or on the date that Public Cab may indicate that such addition, variation or amendment is to come into effect.

Certain sections or pages on this site may contain separate terms and conditions, which are in addition to these terms and conditions. In the event of a conflict, the additional terms and conditions will govern for those sections or pages.

All information submitted to Public Cab via this site shall be deemed and remain the property of Public Cab and Public Cab shall be free to use, for any purpose, any idea, concepts, know-how or techniques contained in information a visitor to this site provides Public Cab through this site. Public Cab shall not be subject to any obligations of confidentiality regarding submitted information except as agreed by the Public Cab entity having the direct customer relationship or as otherwise specifically agreed or required by law.

Public Cab may disclose to all companies within the Public Cab's group of companies or any of its authorised drivers or any government body as so required by the law or by directive or request from such government body or any third party, the particulars of the Customer in the possession of Public Cab in any way as Public Cab Taxi Business, in its absolute discretion, deems fit or if it considers it in its interests to do so.

The customer agrees and consents to the Company using and processing his/her Personal Data for the Purposes and in the manner as identified hereunder.

“Personal Data” means the customer information which includes : name, identification card number, birth certificate number, passport number, nationality, address, telephone number, credit or debit card details, race, gender, date of birth, email address, any information provided by the customer to the Company in online registration forms, or any other similar application forms and/or any information about the customer that has been or may be collected, stored, used and processed by the Public Cab. The provision of the customer’s Personal Data is voluntary.

The Company may use and process your Personal Data for all sort of business and marketing activities of the Company which shall include, without limitation the following:

  • To provide customer with any services pursuant to the Terms of Use herein;
  • To process the customer’s participation in any events, promotions, activities, focus groups, research studies, contests, promotions, polls, surveys or any productions and to communicate with the customer regarding his/her attendance thereto;
  • To respond to questions, comments and feedback from customer
  • To share the customer’s Personal Data within the Company’s group of companies comprising the subsidiaries, associate companies and or jointly controlled entities of the holding company of the group and with the Company’s and Group’s agents, third party providers, developers, advertisers, partners, event companies or sponsors who may communicate with you for any reasons whatsoever.
  • If customer does not consent to the Company processing his/her Personal Data for any of the Purposes, please write in to notify the company.

Public Cab may at any time without giving any reason or prior notice terminate the use of the Online Taxi Booking Services by the Customer.

Use of this site shall be governed by laws of Malaysia and any legal action or proceeding shall be instituted in the Court of Malaysia.
